WHAT COUNTS AS COMPLIANT, AND WHAT DOESN'T.
Clear compensation language
Has to state the paid relationship plainly, like "#ad," "sponsored by," or "I earn a commission." Not enough: vague support language like "thanks to" or "collab," which the FTC treats as non-compliant on its own.
Placed before the fold
Instagram and TikTok truncate captions around 125 characters before the "more" tap. A disclosure buried past that point doesn't count as conspicuous, even if it's there.
Spoken or on-screen in video, near the start
On YouTube and TikTok, the disclosure needs to land close to when the sponsored content actually appears, not buried in an outro. A "sponsor" mention at minute 38 of a 39-minute YouTube video is a real case we caught that didn't hold up.
Platform tags help, but don't replace disclosure
Instagram's "Paid Partnership" label, TikTok's branded-content toggle, and YouTube's "Includes paid promotion" checkbox are good signals, but not enough on their own if the caption or spoken content never says it too.
YouTube: we check what's said, not just what's written
YouTube has no ground-truth partnership flag available to a third-party checker, so most tools only scan the video description. We also scan the transcript, since creators often disclose out loud even when the description misses it entirely.
Survives the repost
A caption compliant on Instagram can lose its disclosure entirely when re-cut for TikTok. That's a new violation, not a carried-over pass. We check both sides, not just one.
